Welcome to SureSafety! We specialize in providing top-quality health and safety training and courses. These Terms and Conditions govern your use of our website and services, and by accessing or using our services, you agree to comply with and be bound by the following terms. If you do not agree with any part of these terms, please contact us about the services in question. SureSafety does not represent or warrant that any of the information presented on its web pages, this website or on the Internet generally will be uninterrupted or error-free, that defects will be corrected, or that this website or the server from which it is accessed is free from viruses, worms, Trojan Horses or other harmful components.

These terms and conditions act as an agreement between SureSafety Ltd, students, any external Company, Customer or user and you agree to all these Terms and Conditions set out by SureSafety Ltd.

In these Terms and Conditions:

'Agreement' refers to a contract between SureSafety and another party for the purchase of Training or other services;
'We' and 'Us' and 'Our' means SureSafety Ltd;
'You' and 'Your' means a customer;
'Website' means the SureSafety Ltd website at URL www.suresafety.co.nz;
'Service', 'Services' means any service that is provided by SureSafety Ltd including but not limited to training courses, advisory services, or audits;
'Product' means any courses, product or Service offered by SureSafety Ltd;
'Customer', ‘Customers’ includes any person buying or registering for a service from SureSafety Ltd.

Changes to Terms and Conditions
Terms and Conditions and products are subject to change at any time during the terms of this agreement. We reserve the right to update these Terms and Conditions from time to time and if we do so we will update the date of this document.

Customer Obligations
The Customer shall provide reasonable co-operation with SureSafety Ltd in all matters relating to the training or services and provide SureSafety Ltd with any information which may be required by the organisation and ensuring that such information is complete and accurate in all material respects. Without the express written permission from SureSafety Ltd, the Customer shall not, and, where applicable, shall ensure that the students/users do not:
Record the training in any way/ Reproduce, scan or copy, alter, modify, translate (in each case, whether in whole or in part) the training materials except for the sole purpose of completing the training; or permit the training materials (whether in whole or in part) to be reproduced, scanned, copied, combined with or become incorporated into any other materials.
For Training delivered online, the Customer shall ensure that it or, if applicable, the students/users can meet the basic technical system requirements for hardware and software as may be prescribed by SureSafety Ltd from time to time, and does not upload any content that infringes upon the rights of third parties, are in contravention of applicable law, or would lead to SureSafety Ltd being in contravention of applicable law.
Cancellations/Rescheduling
Cancellation or rescheduling of training courses and booked services must be made in writing to admin@suresafety.co.nz. Our standard cancellation fees are based on full course costs and will be incurred on the following basis:

Where you have given notification to SureSafety Ltd at least 8 working days before scheduled training or booking there is no cancellation or rescheduling fee.

Where you have given notification to SureSafety Ltd within 3-7 working days before scheduled training or booking there is a 50% cancellation or rescheduling fee.

Where you have given notification to SureSafety Ltd 2 working days or less in advance of scheduled training or booking there is a 100% cancellation/reschedule fee.

SureSafety Ltd will not be liable for any costs incurred by the Customer due to cancellation arising from circumstances beyond our control including but not limited to Trainer illness.

Use of our services
​
SureSafety offers a range of health and safety training and courses designed to enhance workplace safety and compliance. These services are provided through our website and may require registration or subscription. To access certain features of our services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Intellectual Property
All materials provided on our website, including but not limited to text, graphics, logos, and course materials, are the intellectual property of SureSafety or are used with permission. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without express written permission by us.

User Conduct

You agree not to use the website or services for any unlawful purpose or in any way that interrupts, damages, or impairs the service. Additionally, you agree not to attempt to gain unauthorized access to our computer system or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Service or our website.

Pre-Course / Post-Course Requirements
The Customer accepts full responsibility for failure to abide by any pre-course or post-course requirements. This includes, but is not limited to, completing, and returning course paperwork, evidence of competency, and attestation forms.

Online and Self-Managed Learning
Online Training Cancellation may only be made in writing provided the user login has not been activated. If online training is cancelled, or an extension/re-sit is required, a $60.00+GST administration fee will apply. Online training logins will expire after 60 days from the issued date or as per individual supplier agreement. There will be no refund on expired logins or logins that have not been activated within 60 days.

Failure to attend audits
Failure to attend a scheduled audit will result in a “NS” audit status. All NS audits will be charged the full cost of travelling and 2 hours of consultancy.
Cancellations/Rescheduling of services
Cancellation or rescheduling of booked services must be made in writing to admin@suresafety.co.nz or via phone to the auditor as set out below. Our standard cancellation fees are based on travel costs and two hours of consultancy and will be incurred on the following basis:

Where you have given notification to SureSafety Ltd at least 8 working days before scheduled services there is no cancellation or rescheduling fee.

Where you have given notification to SureSafety Ltd within 3-7 working days before scheduled services there is a 50% cancellation or rescheduling fee.

Where you have given notification to SureSafety Ltd 2 working days or less in advance of scheduled services there is a 100% cancellation/reschedule fee.

SureSafety Ltd will not be liable for any costs incurred by the Customer due to cancellation arising from circumstances beyond our control including but not limited to auditor illness.

Attestation Forms
Where an Attestation Form is required, the student will have a timeframe given from the date of the course to complete and return the form to SureSafety Ltd. Failure to return a completed Attestation Form before the due date may prevent the unit standard from being processed as competent.

Failure to attend the training
Failure to attend a course will result in a ’No Show’ attendance status. All ‘No Shows’ will be charged the full course cost.

Late Student Arrival
Within 30 minutes of the scheduled start time: The trainer will inform the student that he may remain on course only at the trainer’s discretion, especially refresher training.
Over 60 minutes of scheduled start time: Student may not attend the course. Should it be necessary for the student to return to complete the course at a later date due to late arrival issues, SureSafety Ltd reserves the right to pass on any associated costs to the student or their employer.

Course/Training Schedule
The availability of courses and dates published on the Website are subject to change without notice. We reserve the right to cancel or alter the dates of any ‘open’ courses due to insufficient numbers of students. Course duration may vary based on the number of students attending and level of knowledge and/or experience.

Communication
You may occasionally receive evaluation material, e-newsletters and promotional emails from SureSafety Ltd once the booking form has been returned. You can unsubscribe by following a link in any of the emails you receive. SureSafety Ltd will not pass your email on to any 3rd party unless required to do so by law.

Unsafe conditions
We reserve the right to suspend training if it would lead to a breach of the Health and Safety at Work Act 2015 (“HSWA”), or where continuing might place students at an unacceptable level of risk. We reserve the right to refuse to train any person who is deemed by us to be unfit due to health reasons including but not limited to intoxication or behavioural issues.

Competitors
We reserve the right to refuse to train any company, employee or individual who we reasonably believe may be in competition with us.
​
Emergency Contact
The student/user or customer gives SureSafety the authority to use the emergency contact number registered, in the event of an emergency or health and wellbeing event whilst the student is attending a course or during any activity while on site.

Company Site Specific Courses
If training is held at the Customer’s premises the Customer agrees to provide all Health and Safety site requirements including policies and procedures that may impact services. The Customer agrees to provide all facilities including; a training room, air-conditioning/heating, bathroom access, power outlets, tables, chairs, whiteboard, projector screen/white wall, and tea/coffee facilities. Facilities for specific courses are as specified in the confirmation email and are according to the course requirements. SureSafety has the right to complete a venue pre-check to ensure suitability, if an alternative venue is required, cost will be the responsibility of the customer.
Safety Gear and Personal Protective Equipment (PPE)
Under the HSWA, all students are required to comply with any instruction, policy or procedure issued by SureSafety with the use of PPE. This includes, but is not limited to, the wearing of hard hats and safety footwear. Failure to comply may result in a student being removed from the course in the interest of health and safety. Should it be necessary for the student to return to complete the course at a later date, SureSafety reserves the right to pass on any associated costs to the student or their employer.

Entry Standards
All students must have a level of written and oral English equivalent to NCEA level 1 (year 11) or IELTS 5.5 or higher, to be eligible to enrol on our courses. The person responsible for making bookings or authorising attendance at the course must agree to these Terms and Conditions before acceptance of their student(s) onto the course.
Where a student does not meet our English language requirement a reader/writer must be supplied by the student or the person responsible for authorising the student’s attendance. The reader/writer cannot be another student attending the same course. Harness courses have a weight limit of 135kg due to harness weight limit restrictions.

Special Requirements of Students
SureSafety Ltd must be advised if the student has any special requirements including but not limited to health, literacy, and cultural requirements.

Payment Terms
Details regarding the payment for and the refund policy of our courses and services should be reviewed before you make a purchase. We reserve the right to change our prices at any time.

Payment Terms 'On Account'- The Customer agrees to make full payment for Services in accordance with approved payment terms.
‘On Pre-payment’- The Customer agrees to make full payment for services at the time of booking. An invoice will be mailed to you and full payment will be made to attend the course.
​
The Customer agrees to pay interest of 5% per month on all overdue amounts. The Customer agrees to pay SureSafety all agency collection fees associated with the collection of an unpaid debt.
Travel and Accommodation – Away courses
The Customer agrees to pay any additional costs incurred by SureSafety Ltd, such as travel and accommodation when local resources is unavailable. These charges will be charged at cost to the customer and will be advised during the booking process.

Prices and Additional Fees
The prices published on the Website are subject to change without notice unless you have an agreement with us stating otherwise.
Issuing Replacement Cards will incur an administration fee of $30.00+GST per card and requires payment before the request can be completed. Issuing ‘Urgent Competency Reports’ will incur an administration fee of $35.00+GST per report and requires payment before the request can be completed.

NZQA Framework Registration
As an NZQA accredited Private Training Establishment (PTE) we upload credits to the NZQA Framework within 3 weeks following course completion based on awarded competency. Additional charges will apply per extra unit/credit added at the time of booking.

Interpreters
​
All NZQA courses offered do not allow any interpreters. NZQA requirement is that the student must be able to perform all assessments on his own without an interpreter. For all other non-NZQA courses on notification to SureSafety the student may bring his interpreter at the learner's own cost. Max 2 students per 1 interpreter.
​
Requirement for Completion
Learning objectives are detailed at the beginning of each training module and assessment is conducted throughout the course. Students are required to attend the full duration of the course. A practical assessment may also be conducted in some courses/programmes. Students will be required to achieve the required level of competency in all areas of the assessment to be awarded the unit standard(s) and credits. Assessment is conducted in compliance with competency-based assessment according to NZQA criteria.

Competency
SureSafety Ltd. intends to mark a course student as Achieved “A” or Not Achieved “NA” upon completion of the course. A student who is marked as “A” will receive an electronic Certificate or card within 3 weeks of completing the course. A student who is marked as NA cannot have the unit standard accredited to them and will not receive any certification. Students have the right to re-assessment for any course where they did not receive competency. The Customer will be advised if a student is marked NA with an explanation given. A plan will be developed with the Customer to ensure that the student has all opportunities available to achieve competency status on a case-by-case basis.

Languages
These Terms are only available in English. No other languages will apply to these Terms or any agreements.

Disclaimers and Limitation of Liability

Our website and services are provided on an "as is" and "as available" basis. SureSafety does not make any representations or warranties of any kind, express or implied, as to the operation of our services or the information, content, materials, or products included on our services.

Privacy Act
​
SureSafety collects and stores information to comply with the requirements of the Tertiary Education Commission (funding and student statistical returns), New Zealand Qualifications Authority (Record of Learning and Unit Standard outcomes), employers (academic outcomes) and Industry Training Organisations (funding and academic outcomes). The information is also used to select students for qualifications, to manage internal administrative processes, and for internal reporting. Information about students may be supplied to, and sought from, other educational institutions for the purpose of verifying academic records. In addition, when required by statute SureSafety leases information to Government agencies such as the New Zealand Police, Department of Justice, Department of Work and Income, and the Accident Rehabilitation Compensation Corporation (ACC), NZ Immigration Service.
Governing Law

These Terms and Conditions are governed by and construed following the laws of New Zealand, without giving effect to any principles of conflicts of law.
